Terms of Service

These are the terms you agree to when you buy a card or start a plan with us. We've tried to write them in plain English rather than hide anything in the length.

Agreeing to these terms

These terms are an agreement between you and FavorTap LLC, a Texas limited liability company (“FavorTap”, “we”, “us”). They apply when you buy a card from us, start a management plan, use our website or app, or use our support chat. If you are agreeing on behalf of a business, you are confirming that you have the authority to bind that business.

If you do not agree with these terms, don't use the service. If you are already a customer and we change these terms in a way that matters, you can cancel — see “Changes to these terms” at the end.

What we sell

FavorTap sells physical NFC “tap” cards, as a stand or a sticker. When someone taps a card with their phone, they are taken to a web address you choose — normally your Google review page. Every card includes a free dashboard where you can track taps and change where your cards point. We also sell an optional management plan, under which we actively monitor your reviews, draft or post responses on your behalf, flag reviews that break Google’s policies, send a monthly report, and replace lost or damaged cards up to the allowance for your plan.

Cards can be bought outright with no ongoing plan. A management plan is optional and separate from the cost of the cards themselves. When you start a management plan, your second card is included free — this is standing pricing, not a limited-time offer. If the plan is cancelled, you keep the free card; we do not bill you for it afterwards.

We ship to US addresses only. Shipping is free. Orders ship within 2–4 business days of payment, and we email your tracking number when they do; you can also follow your order in your account. If a card arrives damaged or doesn’t work, email support@favortap.com within 30 days of delivery and we will replace it free, with or without a plan — this 30-day window covers a card that was faulty on arrival, and it applies to every order including cards bought outright with no plan. Separately, a management plan includes a set number of free replacement cards each year for cards lost, damaged or stopped working at any time, not just in the first 30 days; that yearly allowance applies while your account is in good standing, meaning your plan payments are up to date. Do not mail the card back to us — a replacement never requires a return, and we do not accept mailed returns. Please recycle or dispose of the faulty card.

Plans, pricing and automatic renewal

We currently offer three management plans. All of them renew automatically until you cancel:

  • 3-Month Plan — $85 for the first month, then $165 per month starting one month later. Three-month minimum term. Renews monthly. Includes 1 free replacement card per year.
  • 6-Month Plan — $825 charged at signup, covering six months in full. Renews every 6 months at $825 unless cancelled. Includes 2 free replacement cards per year.
  • 12-Month Plan — $1,650 charged at signup, covering twelve months in full. Renews every 12 months at $1,650 unless cancelled. Includes 3 free replacement cards per year.
  • All plan prices are before sales tax, which is added where it applies.
  • The yearly replacement-card allowance on each plan applies while your account is in good standing, meaning your plan payments are up to date. See the shipping and replacements section above for how that differs from the 30-day faulty-on-arrival replacement, which applies to every order.

Every plan renews automatically until you cancel. Your next renewal date is shown in your account, we email you about a week before a 6- or 12-month plan renews, and you can cancel in your account yourself at any time — two clicks, no phone call, no retention script.

Prices do not include sales tax. Where sales tax applies, it is calculated from your address and added at checkout, and shown on the payment page and your receipt before and after you pay. We do not add a processing fee, a card surcharge, or any other charge of our own. Card prices sold in person are agreed at the point of sale and may vary. Prices for future renewal periods may change, but we will tell you by email at least 30 days before a changed price takes effect, and you can cancel before it does.

Cancelling

You can cancel yourself from your account at favortap.com/account, at any time. It takes two clicks. We will not make you call anyone or sit through a retention script, and we will confirm your cancellation in writing by email.

On the 3-Month Plan you can cancel at any time. If you cancel during the first three months, your plan ends when the three-month minimum term is up, and the monthly payments until then are still charged. On the 6- and 12-Month Plans you can cancel at any time to stop the next renewal. In every case, your service continues until your plan ends — we do not cut you off the moment you cancel — and nothing is charged after that.

We do not generally refund amounts already paid, including the unused remainder of a prepay period. The exception is that if we fail to deliver the service — for example your cards stop redirecting and we do not fix it within a reasonable time after you tell us — email us and we will make it right, including a refund where that is the fair outcome.

We may suspend or end your plan if payment fails repeatedly, or if you use the service in a way these terms prohibit. If we end your plan for any reason other than your breach of these terms, we will refund the unused portion of anything you have prepaid.

Your cards

Cards you have paid for are yours. If you end a management plan, you keep the physical cards and your free dashboard, including tap tracking and changing where your cards point. What ends is the plan itself: active review monitoring, review responses, monthly reports, and free replacement cards.

Free replacement cards under a plan cover cards that are lost, damaged, or stop working in normal use, at the annual allowance listed above. They are not intended to cover bulk re-ordering, and we may decline a replacement request that is plainly not a replacement.

Using the service honestly

FavorTap exists to make it easier for real customers to leave real reviews. Using it to do anything else is a breach of these terms. Specifically, you agree not to:

  • Offer payment, discounts, free items or any other incentive in exchange for a review, or condition anything on a customer leaving one.
  • Filter or gate who is asked for a review based on how they feel — for example only presenting the card to customers you already know are happy.
  • Write, buy, or solicit fake reviews, or ask anyone to review a business they haven't actually used.
  • Point a card at a destination that is deceptive, unlawful, or unrelated to your own business.
  • Attempt to access our systems, other customers' data, or accounts that are not yours.

This isn't boilerplate. Incentivised and gated reviews violate Google's policies and the FTC's rules on endorsements, and they put your business — not just your FavorTap account — at real risk. If we find a card being used this way we will deactivate it.

What you send us

When you message us through the support chat or by email, you keep ownership of what you write. You give us permission to use it for the purpose you sent it — answering you, fixing your problem, and keeping a record of the conversation.

Don't send us material you don't have the right to send. If you believe something sent to us infringes your copyright, email support@favortap.com with a description of the work, where it appears, your contact details, and a statement that you believe in good faith that the use is not authorised. We will review and remove infringing material.

Service availability and third parties

We aim to keep the tap redirect working continuously, because it is the part that matters most. We cannot promise the service will never be unavailable. We rely on third-party providers — including Stripe for payments, Supabase for data hosting, and Vercel for hosting — and an outage at one of them can affect us.

We also do not control Google, Apple, or any other review platform. If a review platform changes its policies, its URLs, or how reviews are displayed, that is outside our control, and we cannot guarantee any particular number of reviews, ratings, or business results from using FavorTap.

Disclaimers and limits on liability

Except where the law does not allow us to say so, the service is provided “as is”, without warranties of any kind, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business, even if warned they were possible. Our total liability to you for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability for fraud, for wilful misconduct, or for anything else that cannot legally be limited.

Disputes — please read this section

This section affects how legal disputes between you and FavorTap are resolved. It requires most disputes to go to individual arbitration rather than to a court or a jury, and it waives your right to take part in a class action. You can opt out within 30 days and keep your right to sue — see below.

First, talk to us. Before starting arbitration, email support@favortap.com describing the problem and what you want. Most things get solved here. If we haven't resolved it within 30 days, either of us can begin arbitration.

Arbitration. Any dispute arising out of or relating to these terms or the service that isn't resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Texas or conducted remotely at your election. Judgment on the award may be entered in any court with jurisdiction. FavorTap will pay the filing and arbitrator fees for claims under $10,000.

Class-action waiver. Disputes will be brought only in an individual capacity. Neither of us may bring a claim as a plaintiff or class member in a class, collective, or representative action, and the arbitrator may not consolidate claims or preside over any form of representative proceeding.

Small claims. Either of us may instead bring an individual claim in small claims court, if it qualifies. Nothing here stops that.

Opting out. You can reject this Disputes section entirely by emailing support@favortap.com with the subject line “Arbitration Opt-Out” within 30 days of first agreeing to these terms. Include your name and business name — that is all we need. Opting out costs you nothing, changes nothing else about your account, and we will not treat you differently for it.

If the class-action waiver above is found unenforceable, the whole of this Disputes section does not apply and disputes go to court instead. The rest of these terms still stand.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Where the Disputes section above does not apply, the state and federal courts located in Texas have exclusive jurisdiction.

Changes to these terms

We may update these terms. If a change materially affects your rights or what you pay, we will email account holders at least 30 days before it takes effect, rather than relying on you to re-read this page. If you don't agree to the change, cancel before it takes effect and it won't apply to you.

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing something straight away doesn't mean we've given up the right to enforce it later.
